These terms govern your use of tsmcalibrations.com and any purchase from TSM Calibrations ("we," "us," "our"). By using this site or placing an order you agree to these terms. If you do not agree, do not use the site or purchase from us.

1. Eligibility

You must be at least 18 years old and able to enter a binding contract to purchase from us.

2. Products and pricing

We sell custom engine and transmission calibration files, flash devices, cables, parts, and merchandise. Prices are in U.S. dollars and may change without notice. We may correct pricing or description errors and cancel affected orders with a full refund at our discretion. Product images are for illustration.

3. Custom tuning – your responsibilities

When purchasing tuning you agree to:

  • Provide an accurate VIN, year, make, model, transmission type, and a complete list of all current modifications.
  • Ensure the vehicle is in sound mechanical condition with no existing fault codes, fuel-system issues, or hardware failures before tuning.
  • Follow all installation and flashing instructions we provide.
  • Contact us before making further modifications so the calibration can be updated.

Calibrations are built from the information you provide. We are not responsible for problems caused by inaccurate or incomplete information.

4. Off-road, competition, and emissions notice

Some calibrations are designed for vehicles used exclusively in closed-course competition or off-highway applications and may alter or disable factory emissions-related systems. Products designated as off-road or competition use only are not legal for sale or use on public roads, streets, or highways in the United States and may not be legal in your jurisdiction.

You are solely responsible for determining whether a product is legal to install and use on your vehicle where you live, and for complying with all federal, state, and local laws, including the Clean Air Act and California Air Resources Board regulations. By purchasing an off-road or competition product you certify that the vehicle will be used only for those purposes. We do not sell, and you agree not to purchase, products intended to defeat emissions controls on vehicles operated on public roads.

5. Warranty disclaimer

Modifying a vehicle's factory calibration may void the manufacturer's warranty. All tuning products and services are provided "as is" and "as available" without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee any specific horsepower, torque, fuel economy, or performance result. Parts and devices carry only the warranty provided by their manufacturer.

6. Limitation of liability

To the fullest extent permitted by law, TSM Calibrations, its owners, and employees are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any engine, transmission, drivetrain, electrical, or other vehicle damage, loss of use, towing, repair costs, lost profits, or personal injury arising from the purchase, installation, or use of any product, even if we were advised of the possibility. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

7. Assumption of risk and indemnification

You acknowledge that modifying a vehicle's calibration and operating a modified vehicle carries risk. You assume all such risk. You agree to indemnify and hold harmless TSM Calibrations from any claims, damages, or expenses (including attorney's fees) arising from your use of our products, your breach of these terms, or your violation of any law.

8. Intellectual property

Calibration files are licensed, not sold. You receive a non-transferable license to use the file on the single vehicle identified by the VIN provided. You may not copy, share, resell, reverse-engineer, or distribute any file. All site content, logos, and calibrations are the property of TSM Calibrations.

9. Support

Tuning support is provided by [email/text/phone] during [business hours] for [90 days] after purchase. Support covers the calibration file itself; it does not include mechanical diagnosis or installation of parts. Revisions requested because of new modifications may incur a fee.

10. Orders, shipping, and delivery

Tuning products are digital. Calibration files are delivered electronically to [the email or tuning-platform account provided at checkout], typically within [2–5 business days]. No physical item is shipped for a tuning purchase, and delivery is complete when the file is made available to you.

Merchandise is printed and shipped by a third-party fulfillment partner directly to you. Shipping times shown at checkout are estimates provided by the partner and are not guarantees. Risk of loss passes to you when the carrier accepts the package. Parts and devices, where sold, may ship from us or directly from the supplier. We may refuse or cancel any order for any reason.

11. Refunds

See our Refund Policy, which is part of these terms. All tuning sales are final.

12. Governing law and disputes

These terms are governed by the laws of the State of [State] without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in [County, State], and you consent to their jurisdiction.
